Terms of Service

Welcome to HubMate ("we," "our," or "us"), a roommate matching and housing marketplace platform designed for college students, interns, and young professionals. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform").

By accessing or using HubMate, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

To use HubMate, you must:

• Be at least 18 years old, or have parental consent if you are a minor
• Provide accurate, current, and complete information when creating an account
• Have the legal capacity to enter into binding agreements
• Not have been previously suspended or banned from the Platform

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

To access certain features of HubMate, you must create an account. When registering, you agree to:

• Verify your identity using a valid .edu email address
• Provide accurate and complete information
• Maintain and update your account information
• Maintain only one account per person
• Keep your login credentials secure

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

You are solely responsible for the accuracy and completeness of any listings or content you post on HubMate. You represent and warrant that:

• All information in your listings is accurate and current
• You have the legal right to post the listing
• Your content does not violate any laws or third-party rights

By posting content on HubMate, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and modify your content for the purpose of operating the Platform. We reserve the right to remove any content that violates these Terms.

HubMate allows users to create and join roommate groups. As a group organizer, you are responsible for:

• Accurately representing your group and its members
• Vetting potential members appropriately
• Maintaining a respectful and safe group environment
• Setting clear expectations for group members

We do not guarantee group compatibility or successful roommate matches. All decisions regarding group membership and housing arrangements are made independently by users.

HubMate provides messaging features to facilitate communication between users. You agree to:

• Use messaging only for legitimate housing and roommate-related purposes
• Treat other users with respect and professionalism
• Meet potential roommates in public places initially
• Verify identities before sharing personal information
• Report suspicious or inappropriate behavior immediately

While we monitor Platform communications for safety, we cannot guarantee the security or authenticity of all communications. Use your best judgment and follow our Safety Guidelines.

HubMate facilitates connections between users but is not a party to any rental agreements or financial transactions. You understand that:

• All rental agreements are solely between users and landlords
• We do not handle security deposits or rent payments (currently)
• You are responsible for all lease agreements and financial obligations
• We are not responsible for disputes arising from rental transactions

If we introduce payment processing features in the future, additional terms will apply.

The HubMate Platform, including our logo, design, and code, is owned by us and protected by intellectual property laws. You retain ownership of content you post, but grant us a license to display it on the Platform.

You may not copy, modify, distribute, or create derivative works of the Platform without our written permission.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE SPECIFICALLY DISCLAIM:

• Any guarantees about roommate compatibility or successful matches
• Accuracy or completeness of listings posted by users
• Responsibility for disputes between users
• That we provide real estate professional services
• That the Platform will be uninterrupted or error-free

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUBMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability to you for any claims shall not exceed $100 or the total fees you paid to us in the 12 months preceding the claim, whichever is greater.

You agree to indemnify and hold HubMate harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

If you have a dispute with HubMate, please contact us first at hello@hubmateapp.com. We encourage informal resolution.

If we cannot resolve a dispute informally, disputes will be resolved through binding arbitration in accordance with Massachusetts law, except where prohibited by law.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform.

Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem necessary.

You may terminate your account at any time by contacting us or deleting your account through your settings.

Upon termination, your right to access the Platform will immediately cease, and we may delete your account and associated data.

• Governing Law: These Terms are governed by Massachusetts law.
• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and HubMate.
